Federal Judge Rules in Favor of Marc Stephens in $20 Million Lawsuit against Stockton University, Robert Blaskiewicz Jr., Det. Michael Matteoli, Atlantic County Prosecutors, and Attorney General

On May 16, 2023, Federal Judge Karen Williams, from the District Court of New Jersey in Camden, issued an opinion partially in favor of Plaintiff Marc Stephens. The Superior Court case involved criminal charges of Cyber Harassment being filed against Marc Stephens. Stephens, who represented himself, won the criminal case when Superior Court Judge Pamela D’Arcy ruled in his favor dismissing the indictment.

Stephens then filed a $20 million civil complaint in federal court against the Atlantic County Prosecutors, Skeptics Society Professor Robert Blaskiewicz, Jr., Detective Michael Matteoli, Stockton University, and the New Jersey Attorney General for filing false police reports, false evidence, false testimony to a grand jury, defamation, and malicious prosecution.

DR. SEBI, DR. BURZYNSKI, AND MARC STEPHENS TARGETED

The court record reveals that three individuals were targeted by a group that operates anonymously online. Those three individuals included Alfredo Darrington Bowman, aka Dr. Sebi, a Honduran herbalist healer, who also practiced in the United States, Dr. Stanislaw Burzynski, a nationally and internationally recognized physician who pioneered the use of biologically active peptides for the treatment of cancer, and Marc Stephens who was the owner and CEO of MAS Acquisitions, Inc., a wireless telecommunications company based in Santa Monica, California, that negotiated and built the wireless infrastructure for wireless cell phones throughout the United States for telecommunication companies such as Sprint Nextel, T-Mobile, and Verizon.

All three individuals, Dr. Sebi, Dr. Burzynski, and Marc Stephens experienced an unrelentless attack on their businesses, and were subject to multiple frivolous court cases filed against them for several years.

Marc Stephens, without lawyers, was able to successfully beat multiple frivolous criminal cases filed against him in Los Angeles, California.

One incident, which has interesting connections, shows that Stephens was unlawfully detained at the Wilshire Division Police Department in Los Angeles.  The Wilshire Division was behind the investigation of Christopher Wallace aka Notorious BIG and Tupac Shakur fued.  Both Shakur and Stephens were born in Harlem, New York and are linked to the Black Panthers.  The Police report reveals that a Vanessa Maria Perez lived with Marc Stephens on Blackburn Avenue in Los Angeles, which is a few blocks away from the Beverly Center.

Both Stephens and Perez were booked at the Wilshire Division Police Station.  It turns out that Vanessa Maria Perez is actually V. Stiviano, the female who took down NBA Clippers owner Donald Sterling.

On Stephens’ Facebook page it reveals that he was childhood friends with NBA legend Malik Sealy, and that they both grew up in the same housing projects in the Bronx, New York.  Malik Sealy, whose father was a bodyguard for Malcolm X, was a former NBA Clippers player for Donald Sterling, who was killed in a car crash.  The records show Marc Stephens is the person who signed a letter of recommendation for V. Stiviano to work with Donald Sterling.

After Stephens cross examined the LAPD officers during a probable cause hearing, all charges were dismissed after Judge James Bianco ruled in favor of Stephens.  Stephens, who represented himself, proved that the LAPD detectives at the Wilshire Police Department tried to frame him with multiple crimes.

According to Stephens, the scheme was to sabotage his wireless telecommunication business which operated in Las Vegas, Los Angeles, San Francisco, New Jersey, and New York.

BURZYNSKI CLINIC HIRES MARC STEPHENS

In 2010, the word got out about Stephens’ success in court.  The Burzynski Clinic reached out to Stephens and hired him as a consultant to assist with the harassment at the Burzynski Clinic and online defamation. The court record states Burzynski hired Stephens as a "cyber security expert".

Stephens successfully stopped the online harassment, and increased awareness of the Burzynski Clinic treatments for cancer, which is located in Houston, Texas.  Cancer patients, from around the world, started reaching out and traveling to the Burzynski Clinic.

Stephens was also able to figure out the location and names of the individuals hiding behind the ‘anonymous group’ who were attacking businesses. Stephens initially thought little kids were playing around on the internet hacking and harassing businesses.

When Stephens looked further into the matter, he was shocked to discover that the individuals were doctors, lawyers, federal prosecutors, FBI agents, police officers, retired judges, journalist, bloggers, scientist, and college professors.

Stephens looked further into the individuals, and learned that they are affiliated with, and members of an international pedophile ring, called “The Skeptics Society”.  Stephens provided the information to the Burzynski Clinic.

The individual who masterminded the campaign to harass Dr. Sebi, Dr. Burzynski, and Marc Stephens is a college professor at Stockton University in New Jersey, named Robert J. Blaskiewicz, Jr.

Marc Stephens submitted video evidence proven that the skeptics have control over the media, politicians, judges, courts, and law enforcement.

On January 8, 2016, Stephens sent an email to Robert Blaskiewicz regarding Dr. Sebi.  In the email, Stephens requested Blaskiewicz to stop sending death threats, hacking his phone and computers, and to remove specific websites, including a website called ‘Advocates for Dr. Sebi’.

Regarding Dr. Sebi, Stephens tells Blaskiewicz, “You Skeptics are attempting to attack”.

On August 6, 2016, 7 months later, Dr. Sebi was pronounced dead.

On March 2, 2017, Dr. Stanislaw Burzynski, who was indicted by the Texas Medical Board, received sanctions. Robert Blaskiewicz was behind the frivolous indictment against Dr. Burzynski.

FABRICATED CRIMINAL CHARGES FILED AGAINST STEPHENS

On November 30, 2017, a fabricated Cyber Harassment complaint was filed by Robert J. Blaskiewicz, Jr. against Marc Stephens.

Robert Blaskiewicz, Jr. is a professor at Stockton University and filed false claims that Marc Stephens harassed him, via email, and threatened physical harm.  Stockton University Police banned Marc Stephens from the University campus.  Marc Stephens showed that Blaskiewics and his skeptics members placed a death threat on his mother's house in Englewood, NJ, which prompt Stephens to move from California.

On September 18, 2018, Marc Stephens was Indicted by the Grand Jurors of the State of New Jersey for the County of Atlantic regarding allegations of Cyber Harassment and threatening physical harm against Stockton University Professor Robert Blaskiewicz, Jr.

On November 3, 2018, Stephens attended his arraignment which was postponed “before” he arrived in court.  At the arraignment, Marc Stephens requested for ‘all evidence’. The prosecutor stated on record that “there is no evidence”. Stephens stated, “if there is no evidence, then there is no case”.

Judge Pamela D’Arcy scheduled a probable cause hearing due to Marc Stephens filing a Motion to Dismiss for Lack of Jurisdiction and violation of Due Process under Common Law.

On January 5, 2022, oral arguments were heard by both Atlantic County Assistant Prosecutor Paige Jedlicka, and Marc Stephens, who represented himself. Stephens argued that even if he created the accounts, the language used is protected by the first amendment ‘freedom of speech’.

Dr. Burzynski submitted evidence to the court in support of Marc Stephens. The evidence showed that Burzynski filed an FBI Complaint against Blaskiewicz for sending death threats at cancer patients and the Burzynski Clinic. Burzynski also submitted a video, created by Blaskiewicz, which showed a bomb blowing up the Burzynski Clinic.

Burzynski complaint to the FBI reads, “To Whom It May Concern: Please allow Mrs. Carolyn Powers to file the complaint with the FBI while I am away in San Francisco at a conference. It was extremely disturbing to find out the latest of what ‘Mr. Robert Blaskiewicz’ would like to do to us. He seems like ‘a psychopath’ that will not stop until we are dead and the Burzynski Clinic is destroyed. He has harassed me and my clinic for years. Thank you for your help, Stanislaw R. Burzynski, M.D., Ph.D.”, EXHIBIT 12 (a18)”.

Marc Stephens submitted evidence to the court that the Skeptics admitted to sending death threats, and was behind attacking Burzynski’s cancer patients.

A “Skeptic Society member” by the name of Tim Farley posted a comment on a blog owned by another skeptic member named Dr. David Gorski, who goes by ‘Orac’ on the internet, admitting the skeptics society members are attacking Marc Stephens and Dr. Burzynski.

“Thanks for the measured reaction. I think we’ve had too many of these ‘mob-like’ reactions in the skeptics community as of late, one of these days it’s going to come back and bite somebody in the form of a libel lawsuit. Some of the Twitter conversations where ‘Burzynski critics’ are directly shouting at current patients are becoming quite distasteful. As Skeptics we need to be careful about going in the direction the evidence is leading us, but no further along than it currently merits” , EXHIBIT 6 (a7)”, says Skeptic Tim Farley.

Stephens was able to prove that Robert Blaskiewicz intentionally filed a frivolous criminal complaint, and was behind creating fake social media accounts, websites, and blogs attacking, and pretending, to be Marc Stephens.

The court documents reveal that the names of the individual members of the Skeptics Society are Frits Bernard, Edward Brongersma, Vern L. Bullough, D.H. Donald Mader, Paul Kurtz, James Randi, Bill Nye, Astrophysicist Neil deGrasse Tyson, Steve Novella, Michael Shermer, PZ Myers, Al Seckel, Stephen Fry, Simon Singh, Edward McGuire, Tim Farley, Andy Lewis, Rhys Morgan, Stephen Barrett, Kenneth P. White, Edward McGuire, Dr. David Gorski, who goes by ‘Orac’ on the internet, and Robert J. Blaskiewicz, Jr. of Stockton University.

After oral argument, Judge Pamela D’Arcy immediately ruled in favor of Marc Stephens.

Judge D’Arcy opinion states, “But most importantly, the email in question did not “communicate a serious expression of an intent to commit an act of unlawful violence”. Instead, the defendant (Stephens) threatened to release an ‘apparently incriminating video’ about the victim (Blaskiewicz). This threat does not rise to the level of “unlawful violence” that is unprotected by the First Amendment. As such, the defendant’s language toward the victim does not constitute a “true threat” and is therefore protected by the First Amendment of the United States Constitution and Article I, paragraph 6 of the New Jersey Constitution. Accordingly, the defendant’s (Stephens) motion is Granted”.

STEPHENS FILES $20 MILLION FEDERAL CIVIL LAWSUIT

On April 4, 2022, Marc Stephens filed a $20 Million federal civil lawsuit for violation of his Right to Due Process, Malicious Prosecution, Frivolous Claims, False Evidence, Negligent Hiring, Intentional Infliction of Emotional Distress, Respondent Superior, and Defamation of Character.

The Stockton University defendants and New Jersey’s Attorney General argued, in their motion to dismiss, that the detectives and the prosecutors are ‘allowed to fabricate evidence’ against Marc Stephens, and that they are ‘immune from damages’ under the 11th amendment of the United States Constitution.

On May 15, 2023, Federal Judge Karen Williams, from the District Court of New Jersey in Camden, issued an opinion partially in favor of Plaintiff Marc Stephens.

Judge Williams ruled that the defendants ‘are not immune’ under the eleventh amendment. But judge Williams ruled against Stephens stating he did not identify any individual prosecutor to be sued in their personal capacity, nothing in the complaint indicated that the Attorney General was involved, that Detective Matteoli is allowed to fabricate evidence and give false testimony to a grand jury, and that Marc Stephens did not file his notice of tort within 90 days, so his claims are barred under State law.

Judge Williams did provide Stephens the opportunity to correct the deficiencies by Amending his Complaint within 30 days.

Marc Stephens plans on filing a motion for reconsideration based on Judge Williams clear error of facts and law, and abuse of discretion.

“The judge is fully aware that police officers are not allowed to fabricate evidence”, says Stephens.

Stephens point to the argument in his complaint where it states, “A police officer who fabricates evidence against a criminal defendant to obtain his conviction violates the defendant's constitutional right to due process of law”. Halsey v. Pfeiffer, 750 F. 3d 273 - Court of Appeals, 3rd Circuit 2014 at 279”.

Stephens has a very strong case and is seeking $20 Million in damages.
